Welcome to Qliam. These Terms of Service ("Terms") cover your use of our email API, visual builder, CRM, and related services.

By creating an account or using our API, you agree to these Terms. If you do not agree, you may not use our services.

1. Acceptable Use Policy

1.1 Anti-Spam (Zero Tolerance)

Critical: Qliam has a zero-tolerance policy for unsolicited commercial email (SPAM).

You agree to comply with:

  • The CAN-SPAM Act of 2003 (USA).
  • GDPR (Europe) regarding consent.
  • All other applicable anti-spam laws in your jurisdiction.

Any account found sending phishing attempts, unsolicited marketing, or emails to purchased lists will be immediately terminated without refund.

1.2 API Usage Limits

Our API is provided for standard business use. You agree not to:

  • Attempt to bypass rate limits or quotas.
  • Reverse engineer the API or use it to build a competing product.
  • Send malicious payloads or attempt to compromise our infrastructure.

2. Data Ownership & Intellectual Property

2.1 Your Content

You retain full ownership of the email templates, subscriber lists, and campaign content you create or upload to Qliam. We claim no intellectual property rights over your material.

2.2 Platform Rights

Qliam grants you a limited, non-exclusive, non-transferable license to use the Service. All rights tailored to the platform itself (code, design, branding) remain with Qbix Labs.

3. Subscription & Payments

Paid subscriptions are billed in advance on a monthly or annual basis. You may cancel at any time, but refunds are not provided for partial billing periods unless required by law.

4. Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms (especially the Anti-Spam policy).
  • Your usage negatively impacts the stability of our platform.
  • We are required to do so by law.

5. Limitation of Liability

To the maximum extent permitted by law, Qbix Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
